A word of caution for independent artists

Just noticed my music up for sale on a site by a company I have no agreement with. It seems that there are a number of companies setting up to offer streaming services in the near future that are 'data mining' material from other companies and then setting up that material for sale on their website and taking all the revenue for themselves. Because you have no agreement with them they are not obliged to pay you when someone downloads your material. So they do little or no work once their server/setup is in place and then take all the profits. It's a real dog-eat-dog world out there!

Jerome, I have no direct knowledge of how to do so but is there a way to "ring-fence" your material to prevent this? Or at least "watermark" it so you have some proof they stole it? What is ASCAP or BMI's position on this? Or other countries' equivalents? They are protective organizations, right? Or at least I thought so...

It would be water off a duck's back to these jokers, unless they were true legal notices. In that case, they'd refer them to their legal counsel and ignore them.

Probably highly illegal, unless these sites are being set up in third world countries.

I'm taking a class this semester in "Entertainment Law" which is the source of all my knowledge on the subject so I can't really offer any significant advice, but, I'm pretty sure you could find a cease-and-desist letter template online somewhere and just customize it to fit the situation and send it to 'em and see where it goes from there, if you want to go through the trouble. :\

I have included a 'digital ID' on the actual audio tracks themselves - might need it one day.

That ain't good.
As an independent artist my default reaction to something like this is: 'well exposure is exposure' but it can get quickly out of hand.
Always a good idea to be prepared for something like this.
I'm that into unsigned music, I made a whole website about it! :peace:
