Is copying music illegal???????????????

Folks i have heard that many composers copy songs from different countries but Bollywood people has even copied "HOTEL CALIFORNIA" by EAGLES take a look at

which is "LAOON KAHAN SE" from film named "JAANE JIGAR"

AGAIN,
heard that super famous GUITARA's(Arabian band) "Ya Ghali" released 2002

indian copied (DUBBED HINDI VERSION i shud say) released for movie GANGSTER in 2006

i dont think copying a song is illegal, but i think that artists actually ask permission from the original guys or whoever own the rights to songs out of respect in order to cover them, sometimes, the original guys do deny the request for a certain artist to record for reasons that only they know...

for example Paul Weller refused Lulu the right to record and release "youre the best thing" back in the 1980s simply because her political views were different to his!

im sure there are other examples of this...

i suppose if someone who wants to record a song with a different melody or tune, or even if they wish to change the original lyrics to a song would be in breach of copyright if they did so without permission...

i do know that Eminem refused Weird Al Yankovic the right to record "lose yourself" as a parody about a decade or so ago...

what these people you have posted are doing, is not wrong IMO, as no one is making money from the recording, so i would doubt there is anything illegal in what they are doing...

maybe Jerome could enlighten us on the legalities of the whole thing, and maybe i am wrong with my interpretations explained above??!!??

ive just gone back and discovered your original links are from movies, therefore im sure there would be legalities involved there due to the fact that was money to be made from these songs in a movie...then again, different countries have different laws regarding this i suppose...the whole thing is probably a very grey area in regards to littigation to say the least???...i dont know, this whole thread is giving me a massive headache thinking about it, think i'll just leave it up to the lawyers to sort out!

Sona, you pose an interesting question ! Decades ago when the Internet, YouTube and dowloading music perse didn't exist, I am quite certain that an artist had to ask for permission to do a cover song. The original artist would get royalties (money) anyway. Now today with music being as common as dirt, it's probably easier to bypass the legal aspects ...I don't really know to tell you the truth. I just know that there are thousands of artists out there, that fact in itself would give lawyers a headache !...lol
